Express Entry

The Express Entry immigration selection system enables individuals and families worldwide to immigrate to Canada in a matter of months. Introduced in 2015, Express Entry has emerged as the primary catalyst for skilled worker immigration to Canada and is widely recognized as one of the most sought-after immigration systems globally.

Managed by Immigration, Refugees and Citizenship Canada (IRCC), Express Entry serves as an application management system overseeing three federal economic immigration programs for skilled workers. It operates as a competitive immigration system, assessing and ranking all eligible candidates against each other. The highest-ranking candidates are then invited to apply for Canadian permanent resident status based on factors such as age, education, language proficiency, work experience, and more.

Provincial Nominee Programs

While the federal government oversees immigration matters for Canada, with certain exceptions pertaining to Quebec, it grants provinces the authority to “nominate” individuals they desire to settle within their jurisdiction. These initiatives are referred to as Provincial Nominee Programs (PNP).

Spousal Sponsorships

Canadian immigration laws prioritize family reunification, allowing citizens of Canada or Permanent Residents (P.R.) to sponsor their spouse or partner, provided they meet the government’s specified requirements.

The Canadian Government classifies Spouse/Partnership relationships into three main categories:

1. **Spouse:** This refers to someone to whom you are legally married, either in Canada or another country, and the marriage complies with the laws of the respective country. Recognition also extends to same-sex spouses as per Canadian law.

2. **Common Law Partner:** This can be a partner of the opposite or same sex. The key criterion is demonstrating that you and your partner have lived in a conjugal relationship continuously for at least one year (12 months).

3. **Conjugal Partner:** This category includes individuals of the same or opposite sex facing exceptional circumstances that prevent them from qualifying as common law partners or spouses through cohabitation. This relationship goes beyond the physical and is characterized by a level of permanence and commitment, with the two individuals relying on each other.

LMIA Based Work Permit

An LMIA is a document issued by Employment and Social Development Canada (ESDC) that assesses the impact of hiring a foreign worker on the Canadian labor market. It is often required for employers seeking to hire a foreign worker through certain work permit programs. Once an employer has a positive LMIA, the foreign worker can use it to apply for a work permit from Immigration, Refugees and Citizenship Canada (IRCC). The work permit application will typically require documentation such as the job offer, a copy of the positive LMIA, and proof of the worker’s qualifications.

Post Graduate Work Permit

International students who have completed a program of study at a designated Canadian institution may be eligible for a PGWP. This permit allows them to work in Canada for a duration equivalent to the length of their study program.
